AMENDMENT ACT OF STATUS OF JUDGE ACT, BANK OF ESTONIA ACT, SURVEILLANCE ACT, DEFENCE FORCES SERVICE ACT AND LEGAL CHANCELLOR ACT RELATED TO THE PERFORMANCE OF SECURITY CHECKS

§ 2. § 11, 2 shall be added to the Bank of Estonia Act (RT I 1993, 28, 498; 30, correction note; 1994, 30, 463; 1998, 64/65, 1006; 1999, 16, 271) in the following wording:

"§11, 2 Security checks of the candidates for the post of the Governor of the Bank of Estonia as well as the Chairman and member of the Board of the Bank of Estonia

1. The candidates for the post of the Governor of the Bank of Estonia and the Chairman and member of the Board of the Bank of Estonia shall go through the security checks before being nominated for the post of the Governor of the Bank of Estonia or the Chairman or a member of the Board of the Bank of Estonia, except in case they possess a valid access permission to access the state secret classified as "top secret".
2. The status of a candidate for the post of the Chairman of the Board of the Bank of Estonia shall have a person to whom the President of the Republic has made a proposal to run as a candidate for the post and who has given his written consent to run as a candidate for the post. The status of a candidate for the post of a member of the Board of the Bank of Estonia shall have a person to whom the Chairman of the Board of the Bank of Estonia has made a proposal to run as a candidate for the post and who has given his written consent to run as a candidate for the post. The status of a candidate for the post of the Governor of the Bank of Estonia shall have a person to whom the Board of the Bank of Estonia has made a proposal to run as a candidate for the post and who has given his written consent to run as a candidate for the post.
3. The security checks of the candidates for the post of the Governor of the Bank of Estonia and Chairman of the Board of the Bank of Estonia shall be performed by the Security Police Board according to the order stipulated in the Surveillance Act (RT I 1994, 16, 290; 1995, 15, 173; 1996, 49, 955; 1997, 81, 1361; 93, 1557; 1998, 47, 698; 50, 753; 51, 756; 61, 981; 98/99, 1575; 101, 1663; 1999, 16, 271; 31, 425; 95, 845; 2000, 35, 222; 40, 251; 102, 671; 2001, 3, 9; 7 , 71).
4. In order to pass the security checks the candidates for the post of the Governor of the Bank of Estonia and for the post of a member of the Board of the Bank of Estonia shall submit via the Bank of Estonia, and the candidate for the post of the Chairman of the Board of the Bank of Estonia shall submit via the Office of the President of the Republic a filled-in form of an applicant applying for the access permission for the state secret classified as "top secret" and a written consent to the Security Police Board by which the authority performing security checks is allowed to obtain information on that person from natural persons and legal persons as well as from public and local authorities and bodies thereof while performing security checks.
5. The Security police Board shall forward to the Board of the Bank of Estonia the data collected as a result of security checks of the candidate for the post of the Governor of the Bank of Estonia, to the President of the Republic the data collected as a result of security checks of the candidate for the post of the Chairman of the Board of the Bank of Estonia and to the Chairman of the Board of the Bank of Estonia the data collected as a result of security checks of the candidate for the post of a member of the Board of the Bank of Estonia within three months on receipt of the documents listed in subsection 4 of this section, enclosing an opinion on the conformity of the candidate to the requirements set for obtaining an access permission to access state secret."
